A patent is an exclusive right to an invention, and can last up to 20 years. The exclusive right implies that no one else can produce, sell, distribute for sale, import or export the patented product. However, the exclusive right does not apply if the utilization is made outside commercial activities, such as production or import for private use.

A preliminary patent search will usually provide answer to the originality of the idea, or in other words the "inventive step".

IP Law Firms/Patent Agencies

In Norway, any Norwegian citizen may prepare and file his/hers own patent application at the Norwegian Patent Office. However, in real life, it is preferred to hand over this responsibility to a IP law firm or patent agency, because the patent attorneys know the system and know how to prepare an application, what it should describe and which term and fees that may apply.

Patent applications abroad

A national patent application can be extended to other countries with so-called priority from the original application. That means that the application abroad can refer back to the national application. In order to obtain this, it is an invariable requirement that the application be filed within 12 months from the filing date of the Norwegian application. Any publication of the subject matter in the meantime will have no effect with regard to the priority right.

Patentability search: NOK 7 000 - 10 000. Norwegian patent application, preparation and filing: NOK 17 000 - 35 000. Treatment costs vary from one application to another, and cannot be estimated.
